On May 29 2019 a draft of the law "On providing amendments to some legislative acts of Ukraine on regulation of maritime search and rescue activities" was read and approved during the sitting of the Verhovna Rada of Ukraine Committee, together with the input of the Minister of Infrastructure of Ukraine Volodymyr Omelyan.
The adoption of this law will ensure scaling of the national legislation to the UNO Convention on Maritime Law, conventions of the International Maritime Organization, will solve a number of legislative issues connected with creation, functioning and development of the National maritime SAR System in the search and rescue region of Ukraine.
Such important positions as legislative support of the efficient functioning of Maritime Search and Rescue Service, regulation of actions of vessel masters during distress, SAR readiness to perform SAR activities at sea, as well as fulfillment of liabilities in accordance with national obligations in the sphere of merchant shipping, in particular, the flag state and coastal state liabilities on protection of human's life at sea, are foreseen to be discussed.
To remind, the following draft of the law was provided by the State Enterprise "Maritime Search and Rescue Service" to fulfill point 5 of the decree of the Cabinet of Ministers of Ukraine by 24.02.2016 № 158 "On renewal of the unified maritime search and rescue system", according to which the Cabinet of Ministers of Ukraine entrusted Ministry of Infrastructure to give suggestions to amendments to the Merchant Shipping Code of Ukraine and to the Law of Ukraine "On the sea ports of Ukraine".
After approval of all the interested central executive bodies, the draft of the Law given by the Ministry of Infrastructure to the Cabinet of Ministers, which approved it and passed to Verhovna Rada of Ukraine. The draft of the Law "On providing amendments to some legislative acts of Ukraine on regulation of maritime search and rescue activities" was registered in Verhovna Rada with the number 9238 dd 24.10.2018.
The draft of the law received positive conclusions from the Verhovna Rada committee, in particular Ecological Policy Committee, Natural Resources and Elimination of Chornobyl Disaster Consequences, the Committee on prevention and countermeasures against corruption and the Budget Committee.
The head Office for Research and Evaluation of Verhovna Rada of Ukraine supported the adoption of this draft in the first reading.
The draft of the law was discussed at the seating of the Maritime and Inland Water Transport Sub- committee of the Transport Committee of Verhovna Rada of Ukraine. The sub-committee made a decision to advise the Transport Committee to support the draft and provided a number of solutions for its improvement, taking into account the remarks of the head Office for Research and Evaluation and the consultants of the transport committee.
At the Transport Committee sitting the draft of the law was supported by the Head of the Maritime and Inland Water Transport Sub-committee Mr. Urbanskiy and his Deputy Head Mr. Kozyr. The Minister of Infrastructure of Ukraine Omelyan, Deputy Director of Department of Reform and Operation of Maritime and Inland Water Transport Ivan Ivanchyk and the Deputy Head of SE "Maritime Search and Rescue Service" Volodymyr Rabotnov.
